Terms of Use

The rules of the service: what PhinApp does, what we expect of you and where the limits lie on both sides.

1.Acceptance

By signing in you state that you have read and accept these terms and the Privacy Policy. If you do not agree with them, do not use PhinApp.

You further state that you are over 18 and that, when registering a company or accepting an invitation on its behalf, you have authority to take on these obligations for it.

2.What PhinApp does

PhinApp is a cash-flow management service delivered over the internet. It imports payables and receivables exported from your ERP, reads bank statements and card bills, reconciles one against the other, forecasts future cash and compares forecast with actuals.

The service evolves: features may be added, changed or discontinued. Changes that materially reduce what it does will be announced with reasonable notice.

PhinApp is not a financial institution, does not move money, does not issue tax documents and does not provide accounting, audit or advisory services.

3.Account, access and roles

Access is through your Google account; we neither create nor store passwords. Keeping that account secure is your responsibility, and whatever is done through it will be treated as done by you. Tell us as soon as you suspect misuse.

Inside each organization access has three levels: administrator, who manages users and settings; editor, who records and changes data; and read-only, who sees everything and changes nothing. Inviting, promoting and removing users is the responsibility of the organization's administrators, and every organization keeps at least one.

An account is personal and must not be shared: everyone who needs access should be invited individually.

4.The data is yours

Everything you record or import into PhinApp remains your organization's. We claim no ownership over it, do not use it for any purpose other than delivering the service to you and do not hand it over to third parties.

In relation to that data we are the processor and your organization is the controller. It is up to the organization to have a legal basis for entering data about suppliers, customers and employees into the service, and to inform those people where required. You authorize us to handle such data to the extent needed to operate PhinApp.

You can export your data at any time from the product's own screens, and request a full copy through the contact channels.

5.Acceptable use

In using PhinApp you agree not to:

  • employ it in any unlawful activity, including fraud, tax evasion, money laundering or concealment of assets;
  • enter data you have no right to, or sensitive personal data;
  • attempt to reach another organization's data, circumvent access controls, probe the infrastructure or exploit vulnerabilities;
  • deliberately overload the service, automate access beyond what is reasonable or scrape content in bulk;
  • copy, decompile, resell, sublicense or offer PhinApp as a service of your own;
  • introduce malicious code or files capable of compromising the service or other users.

Found a vulnerability? Write to before disclosing it. We will not pursue anyone researching in good faith, without reaching third-party data and without degrading the service.

Breaching this section may lead to immediate suspension of access.

6.How accurate the numbers are, and what they are not

PhinApp organizes and projects the data it receives, and the quality of the result depends entirely on the quality of the input: a missing statement, an out-of-date ERP report or a wrong classification produce wrong numbers. Where the service can notice the inconsistency - a range of balances that does not add up, say - it shows it on the screen rather than hiding it; where it cannot, you are the one who can.

Forecasts are estimates about the future, not promises. Projected balances, open amounts and forecast-versus-actuals comparisons exist to support your analysis, not to replace it.

Nothing in PhinApp is accounting, tax, legal or investment advice, and the product's reports replace neither your company's bookkeeping nor its statutory filings. Check the numbers with your accountant before deciding on them.

7.Availability and support

We work to keep PhinApp available, but do not guarantee uninterrupted or error-free operation. There may be downtime for maintenance, upgrades, failures at third parties we depend on, or events beyond our control. Wherever possible, scheduled maintenance will be announced in advance.

Support is provided through the channels indicated in the service, on business days. To investigate a problem our team may need to access your organization - and that access is read-only, as the Privacy Policy describes.

8.Plans and payment

The commercial terms in force - plans, limits and prices - are those stated in the service at the time of contracting. While no charge is active for your organization, use is free of charge and creates no payment obligation.

If and when we start charging, prices, the billing cycle and the cancellation and refund rules will be announced at least 30 days in advance, and no charge will be made without your express acceptance. Applicable taxes will be added to the price where due.

9.Intellectual property

PhinApp - its code, its brand, its visual identity, its documentation and the chart-of-accounts templates it seeds - belongs to PhinApp and is protected by intellectual property law.

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the service under these terms. Nothing here transfers any right over the software.

Suggestions and feedback you send us may be used freely to improve the product, without that creating any obligation of payment or confidentiality.

10.Confidentiality

We treat your organization's financial data as confidential and access it only to operate the service, provide the support you asked for, or comply with a legal obligation. That obligation binds our team and our providers, and survives the end of this relationship.

11.Limitation of liability

To the fullest extent permitted by law, we are not liable for lost profits, lost opportunity, data loss arising from an act of yours or of a third party, nor for business decisions taken on the basis of information in the service.

Our total liability, on any ground, is limited to the amount you actually paid PhinApp in the 30 days preceding the event giving rise to it.

Nothing in these terms excludes liability for wilful misconduct or gross negligence, nor rights the law does not allow to be limited - including those of the Brazilian Consumer Protection Code, where applicable.

12.Termination

You can stop using PhinApp whenever you like, by deleting your account from your profile or by deleting the organization.

We may suspend or terminate access in case of a breach of these terms, a legal requirement or a risk to the security of the service, with prior notice wherever the situation allows.

Once access ends, data follows what the retention section of the Privacy Policy describes. Export whatever you need first: deleting an organization erases its financial data, and that cannot be undone.

13.Changes to these terms

We may change these terms to follow changes in the product, in the law or in commercial conditions. The date they were last updated is at the top of the page, and material changes will be announced by e-mail or inside the application with reasonable notice. Continuing to use the service after they take effect means accepting the new version; if you do not agree with it, close your account.

14.Governing law and venue

These terms are governed by the laws of the Federative Republic of Brazil. The courts of Curitiba, PR are chosen to settle any dispute, waiving any other, save for a consumer's right to sue in the courts of their own domicile.
